A kinsman of President Goodluck Jonathan's,
Hon. Donald Daunemigha, has asked a Federal High Court in Abuja to
disqualify the All Progressives Congress, Presidential candidate, Muhammadu Buhari, over alleged certificate forgery.
In a suit filed by his counsel Barr. Douye Fiderikumo, Daunemigha seeks Buhari's disqualification from the March 28
presidential polls, naming Independent
National Electoral Commission
(INEC) was named as 2nd defendant in the suit, numbered FHC/ABJ/CS/116/15.
Vanguard reports that the plaintiff is asking
the court to issue an order declaring Buhari unfit to run for the office of the
President of the Federal Republic of Nigeria slated in the March 28th polls or
such other time as the 2nd defendant may determine having presented a forged
certificate to INEC.
The Bayelsa politician in his suit also wants
INEC restrained from recognising the candidacy of the APC candidate.
“Also an order of perpetual injunction
restraining the INEC by itself or by its servants, agents, privies however
described from recognizing or treating or accepting the APC flag bearer,
Muhammadu Buhari, as a candidate for the election to the office of President,
Federal Republic of Nigeria slated to hold on the 28th day of March, 2015 or
such other time as the 2nd defendant may determine having presented a forged
certificate to the INEC."
The suits also seeks to determine
"whether in view of the fact that Nigerian Army is not in possession of
the West African School Certificate (WASC) 1961 of the 1st Defendant, the
affidavit presented by the first defendant to the INEC does not amount to
presentation of forged certificate within section 137(1)(j) of the constitution
of the Federal Republic of Nigeria .”
Fiderikumo urged that Buhari be disqualified
for failing to submit all relevant academic credentials with his forms.
He argued that the candidate's INEC FORM CF 001, submitted to INEC was " inchoate and not in
conformity with the form prescribed under the Electoral Act" and should be
therefore declared "incompetent."
The counsel further said Buhari's failure to
present evidence of his educational qualifications and birth certificate render
the INEC form inchoate.
Controversy over Buhari's certificate started
since 2014 and the release of his 1961 West African School Certificate (WASC) results by the Principal of the Government
College, Katsina, only spurred authenticity issues.
According to the results, Buhari obtained the following scores:
English – 5 (credit), Hausa-5 (credit), History -3 (Good), Geography – 6
(Credit), Health Science – 6 (credit), English Lit – 7 (pass), Maths – 9
(Fail) and Woodwork – 9 (fail).
